Обмежені речові права в сільськогосподарському землекористуванні Запорізької області

Abstract

UK: В статті проаналізовано специфічні особливості використання обмежених речових прав на користування чужою сільськогосподарською земельною ділянкою в Запорізькій області, в тому числі по групі районів. Визначено основні рівні та напрями раціоналізації використання обмежених речових прав в сільськогосподарському землекористуванні регіону. EN: The article revealed the relevance of studying the process of acquiring limited real rights to use someone else's land for agricultural purposes for agricultural or industrial and business needs. However, the analysis revealed the objective need for this process in Zaporizhia region. The study analyzed the theoretical foundations of the land law, the current Land Code of Ukraine and determined that the right land easement - the right owner or land user of land for limited paid or free use of someone else's land (plots). Found that the right of servitude is divided into perpetual lease and superficies that under mean the right to use someone else's land for agricultural needs and the right to use it for development. However, when analyzing the peculiarities of acquiring limited real rights for agricultural land is in the Zaporozhye region, which include: excellent climatic features, value and perpetual lease superficies direct correlation concluded agreements, easements regional income and social as economic areas. Also, the mechanism of rationalization of the use of limited real rights in agricultural land use Zaporozhye region, which includes areas of improvement at the state, business and consumer level.
